Call it a progressive society or people obsessed with the desire for sex, the world is changing fast to accommodate the interested couples in most liberal a way. A law is passed in California permitting sex in the campus and this has been done by Governor Jerry Brown to heed to the demand raised by University of California Students Association (USCA) besides certain other organisations. The law permits free sex between the consenting partners in the campus itself if theirs is a conscious decision with affirmative consent and that mentally they are a normal couple. A spokeswoman of California University spoke out her mind on ‘affirmative consent’ like this:

• The affirmative consent definition is one of many factors that is assessed when sexual violence is investigated and adjudicated on our campuses. But it is an extremely important one.

Isn’t it that such laws, if practiced by other countries, provide an alternative to otherwise a ghastly act like perpetrating a rape liberalising the same in public places? Back to the age of Adam and Eve, they could have felt more satisfied to know that there is no more any thing like a 'forbidden fruit' and that can now be relished well even quite publicly.

Summons to Modi on 2002 Gujarat riots:

Summons are issued against the Indian Prime Minister Narendra Modi while he is on his otherwise a stormy visit to America by the US Federal Court for the Southern District of New York on a civil law suit filed by the New York based American Justice Centre (AJC), a non profit human rights organisation along with two survivors of the post Godhra violence. Narendra Modi is required to respond to the summon within 21 days after it is served on him, as the Court said. This is how the news is released by the PTI. Like a bee in the meals the news spoils the taste the Indian populace is enjoying on a tremendously successful visit of the Prime Minister Narendra Modi to America currently. Courts any where in the world have their own way of working boastfully unmindful of the reaction of the people in general. The news read in the context of Indian Court having already disposed of the case much earlier exonerating Modi of the charges so levelled, the instant one practically stands no where.

What finally has emerged is the otherwise unbelievable fact that the key man most instrumental in killing innocent Jyoti was none else but only her husband Piyush who hired killers for her against an amount of rupees 50,000/ to get rid of her facilitating the love affair he had with another woman who has since been taken into custody by the police along with her paramour. Macbeth kills king Duncan as referred to by William Shakespeare in his historical one act play by the same name ‘Macbeth’ and when he goes back home after committing the heinous crime his wife Lady Macbeth comes across distinct blood stains on his apparel and she cries aghast “…the waters of seven oceans can’t wash it”. Yes, the crime Macbeth had committed was heinous and horrible beyond normal imagination but crime of the nature like this was not the last one and it hovers around humanity equally on date and may continue for ever. What happened to Jyoti was something in sequence and series for all time to come as there lies the inbuilt propensity of humans. One only shudders on the mode of horrible cruelty and callousness on the revelation that Jyoti’s husband Piyush had managed to hear the cries and groans of his wife over mobile phone while she was being killed. No kind of punishments available in Law as on date even if they all are applied together for Jyoti’s husband Piyush are enough to do justice to her unless he be half buried on a public place with dog squads biting and snatching his flesh bit by bit like it happened in the olden days.

Satans on a spree targeting businessmen:

The satans, the devils, are on a spree in town targeting businessmen. A married woman Jyoti Deshani aged 27 years was brutally abducted and murdered when she was accompanying her husband Piyush, a business magnate of Kanpur (Uttar Pradesh,India) after dinner in a status hotel. The young woman had 14 major injuries on her body indicating that she had struggled hard for life fighting the attackers who were 6 in number on 3 motor bikes intercepting the couple in the midway on the Mall Road (Mahatma Gandhi Marg) around midnight the other day. Local police, as usual, is unable to trace the criminals nor they are even able to trace any clue behind the ghastly crime and the whole incident is a suspense and mystery. Be it for business consideration, property dispute, rivalry, or rape, the incident of this nature are repetitively rampant every where in the State of Uttar Pradesh (India) and the role of the police in almost all the cases hardly exceeds beyond trivial interrogations as an eye wash. Howsoever heinous and ghastly a crime that is perpetrated is, police always remains in slumber and it hardly ever turns up to the rescue of the victims. The whole scenario is ugly, horrifying and that of an utter chagrin.

Not enough to award cash penalty:

Indian Railways Board has since taken a decision to slap a penalty of one lakh of rupees on their catering contractors if food provided to the passengers is of an inferior quality. Not enough as it may hardly serve any purpose for the reason that the contractors supplying food to the railway passengers earn a lot by providing an inferior food stuff and for them it rather works as an incentive to continue with their supply of bad meals. Money is no problem for them as they earn enough of it through nefarious means. They in fact are required to be criminally proceeded against awarding them harshest possible punishment capable of acting as a big deterrent besides permanently cancelling their licence of contract. Those who play with the life of the rail passengers by providing them mal stuff in no way deserve any sympathy. They only deserve a considerable jail term with no relaxation extending the same pattern of punishment to all others who indulge in providing poison in the name of food to the travellers.

What type of a molestation is this?

Just so peculiar, a boy friend for several years molesting his love as if he was doing something else all this time. Preity Zinta, a famous cine star from Bollywood has lodged an FIR with the local police at Mumbai that there was an attempt of molestation made against her by her ex boy friend and an industrialist Ness Wadia. A bid to molest the other side is normally a prologue to developing physical relations and in the instant case that stage was crossed long back between the two. May be the law doesn’t permit molestation as a sequal to forcible sex even in the case of divorcees but in the matters of love affairs the situation is to be read slightly in a different context of the mutual understanding the couple had continuously for several years where physical union was not at all taken as a forbidden fruit. Possibly the whole episode is the type of much ado about nothing.

As per the ruling given by the Supreme Court of India the women employees in the government offices are now entitled to 730 days leave at a stretch especially to take care of their children below 18 years age. The ruling envisages the care not only for the children in the cradle but even those going to school. The women employees also may have the option of combining the leave due to them in other categories as per their needs. It was a long felt need of the lady staff in the government offices and they have now got it with the Supreme Court intervening in the matter. Much better it was if the government had taken such a decision at their own without the Court’s intervention. Better still it could be if the ruling so given is allowed to be applied to women employees in other sectors too in the country in the case of both public and private undertakings including banks where there is a large number of the women employees working all over the country.

Isn’t it too much of a witch hunting?

Sahara chief Subrata Roy is denied bail by the Supreme Court of India continuously every time he applies for it. He was charged for contempt of court besides non compliance of the court’s order to make upfront payment to SEBI. The amount being too heavy his lawyer requested the court to relax it in which connection he gave an alternative proposal of package which was turned down at the outset itself. On his interim bail proposal the court’s condition is that he should provide sureties to the tune of 10,000 crores of rupees “out of which Rs 5,000 crores to be deposited before this court and for the balance a bank guarantee of a nationalised bank be furnished in favour of SEBI and be deposited before this court”. It appears that there is a deep rooted prejudice working against Subrata Roy as the court is treating with him in too harsh a manner in the name of law. Not necessary that all moneyed people have unlimited money at their quick disposal and certainly he might have offered the utmost he could. Law is blind, it is said, but those who sponsor it are after all humans only. Humanity demands that the torture he is undergoing be reasonably relaxed. Ultimately it is the law to take its course finally when there is the question of exonerating him of all the charges against him but he deserves some consideration in being granted an interim bail giving weightage to his constraints in making payment of otherwise too big a sum of amount. Moreover, he is in advancing age which factor normally the law considers in several cases and let him too be one such case.

Sex with a dog or a bitch –any proof?

There is a story, a real one, of a judge who kept the judgement in a case pending for a long time unable as he found himself as to how go about the very proof part of body contents of the case. The case was a divorce petition filed by a man against his wife on the grounds of infidelity and that she was in the habit of having sex with a dog. The judge was satisfied and fully convinced on the grounds put up by the lawyer of the man concerned but there was nothing like any concrete proof. He was upset and had sleepless nights brooding all along as to how proceed further in the matter. His wife asked him why he was upset and the judge told him the whole story including the problem of the proof. His wife was able to give him a clude. She suggested ‘why not examine upper part of the belly of the petitioner’s wife. If there are paw marks of the dog on her belly, it would clearly indicate that she was having sex with the dog’. The very next day when the judge reached the court the first thing he did was to order necessary examination of the petitioners wife. It was done and the judge found that quite visibly there were the paw marks on her belly. The judge pronounced his verdict upholding the petitioner’s allegation. What happened the next was an amazement as the judge divorced his own wife immediately on reaching his home for obvious reasons that she too had paw marks on her belly which he had failed to notice earlier. Who knows how many females and equally males in the human society could be practicing such a bestiality as zoophiles?

Alluring the electorate:

It is an offence, as the Election Commission puts it, to secure votes against money. No problem, all the political parties have their own tools to override the law based provisions. Those of them who are in power in  some state or the other in India can very well buy the votes by paying the electorate as a well formulated scheme. Samajwadi Party led government in Uttar Pradesh has announced recruitment of 40,000 cleaners and also a compensation of Rs.5,00,000 to the family of those cleaners who die in course of working in some sewer line. They have also announced a payment of Rs.250 instead of  Rs.120 currently to the labour involved. The problem in question has all along been there for several years but increase in number of the cleaners, avenues for employment and amount of compensation look only new ones –thanks to the general elections due the next year that is 2014 which is working as a source of motivation for the politicians to appease a particular class of the community. The scope of employment, increase in the amount of compensation, and payment to daily wagers are a dire need felt always but being generous enough in the context of the elections on the part of the political party concerned give the gestures the shape of a bribe only, it is rather a broad day robbery of public resources.

It matters much when the criminals and the corrupts ultimately get what they actually deserve –a punishment of drastic order. Lalu Yadav was all these years playing lot of gimmic to secure relief for himself in chara ghotala he committed along with others but he ultimately failed to manoeuvre the things. Next one in the sequence is Rashid Masood. Central Bureau of Investigation having dealt with in the matter sternly and honestly has secured some good name for themselves. If the Law and the law agencies work honestly like this, the people of the country have a reason to take a sigh of relief on the front of law and order and also security.

An income commensurate with means:

Not necessary for you to worry if your income far exceeds your visible means. It’s a crime in the eyes of the rules and the laws of the country but if you are capable enough to muster enough of strength by acquiring necessary political equations at the top level, the task is damn easy to manage. Once managed, the rules and laws are rendered as flexible as sand in the rains. The case of disproportionate wealth as against the earnings is pending against Mulayam Singh Yadav for a pretty long time and instead of deciding it on merit, it is allowed to hang in the balance as a source of some political bargain or the other. As limping a government as it is that of UPA in the centre, there is a dire need felt  to trace effective allies to ensure passage of bills in the Monsoon session of the Parliament. The talk in the political corridors is that there is every possibility of the case against Mulayam Singh Yadav being withdrawn or closed by the government to enlist his support. There is hardly any element of amazement if it assumes a physical shape shortly in days to come. The role of rules and laws are after all secondary in nature in our country.

An incentive to terror accused!

To be liberal to an accused is an indirect way of promoting crimes. In fact those indulging in such a liberal move should be supposed to be criminals only in the eyes of the Law. The State Government led by Akhilesh Yadav as its Chief Minister recommended withdrawal of cases against terror accused in 2007 serial blasts in Lucknow, Varanasi and Faizabad which claimed the life of 16 persons injuring 60 others. This he did as a sheer political move as per his party’s promise given during the last elections in the State. A public interest litigation filed by some lawyers disputed such a decision in the court of law. The Lucknow Bench of Allahabad High Court has taken the cognizance of the issue and has posted it for the consideration by a full bench. It is note worthy that a case of the type like this was already decided by the Court in the past rejecting the Chief Minister’s initiative in the matter. Poll promises are generally a matter of personal interest of the individuals and the parties concerned and, if voted to power, they should not be allowed to condone or pardon the criminals as it can in no way be termed as lawful an action, rather it is blatant violation of the Law. Life of 16 persons and those seriously injured numbering 60 in the serial blast is much more important than the personal interest of some individual or any political party.

Adopted sons/ daughters

High Court of judicature at Allahabad recently gave a ruling that an adopted son is as eligible for compassionate appointment as a real son. Several undertakings both in public and private have been denying such appointments on the ground that it is applicable only in the case of real son/ daughter and those who have been granting appointments to the deceased's dependants have been doing so as a matter of their discretion. The ruling undoubtedly gives relief to many who otherwise could have been rendered ineligible. Compassionate appointments are an area which concern the family most after their bread earners die or are severely incapacitated. An issue by legal adoption is supposed to be the legal heir of the deceased otherwise too and by confirming such a position by way of a ruling in the matter the Court has done justice to a large number of people who were in the lurch in the absence of some employment.

Why law is allowed to be blind ?

We are told that the Law is blind possibly for the reason that judgement givers are not supposed to deliver their verdicts based on sentiments but in strict adherence to the very frame of rules. Does it mean that the justice perceived at social level has no room to get accommodated? A recent case is that of a woman, Narayani by name, who unfortunately became a widow within three months of her marriage was dragged out of home and abandoned by her inlaws immediately after death of her husband after which she had no option but to take shelter with her parents. Her parents took care of her, saw to it that she was given proper education and that they also managed her employment on a good salary. After serving her employment for quite some time she died leaving considerable amount of her savings besides provident fund. The Hon'ble court delivered their judgement in favour of the inlaws of the woman placing both the savings and the provident fund at their disposal depriving the parents of the same. What a law? The family that took care of the woman spending lot of amount on her and her education was no consideration for the Court, they rather found it more legal to extend the advantage of her savings and superannuation benefits to her inlaws who callously threw her out of the house. Looks like they are rewarded by the Law for their misdeed.

Glorifying the goons ?

Discarded and disdained, the goons in the society were treated with contempt in the past howsoever big they were as Dons. Now that situation in all fronts including cultural level has undergone a tremendous change, the dons too have acquired a status and they are no more looked upon with a contemptuous gaze. Only the other day, I was watching a TV channel where the news reader was putting up the life sketch of a don in quite a magnified way as if he was a great celebrity. It was Dawood Ibrahim being offerred all praise with emphasis as to how he grew to his present status starting from a grassroot level in Mumbai. His personality, his living style, his rapport with all kinds of people and above all the way he dressed himself to look great using an apparel each time costing around 50 lacs of Indian rupees on an overage and that a dress he used once was never to be used again. Costly jewels and the watch he wore was focussed so much. Does a killer, a top ranking terrorist of the world, a kidnapper of worst order and black marketeer deserve such a praise and highlight is the question. He is a role model for the low level goons operating in streets who have their own style of imitating the monster and that helps them in grabbing money from middle level businessmen and ordinary people. Any place, any street, any location, one can find them in plenty every where making the life of common people so miserable. Who is to stop them? Possibly none is there. Media is the channel supposed to highlight the criminal activities so going on every where but they too have not failed miserably on that count, they are contributing a lot instead in glorifying such elements. Many in administration are closely associated with these anti social elements with the result that they always go scotch free in the even they are caught, caught many a times just as a ritual, as so long they are there in police custody they are given a VIP treatment during the time they are taken into custody or even jailed temporarily. This is so unfortunate not only for this country but for the world as a whole. Possibly we are heading towards a level in society where only rascalism and terrorism has to prevail.
